California Prop 64 legalized adult-use cannabis statewide in 2016 — but each city decides for itself whether to allow retail storefronts and delivery. In Santa Clara County, that means a patchwork. Here's what's actually legal in each Silicon Valley city as of 2026.
Statewide rules first
Anyone 21+ with a valid government ID can purchase from a state-licensed retailer or delivery service. Limits per day: 28.5g of flower, 8g of concentrate, or the edibles/vape equivalent. Delivery must come from a licensed retailer with a state seller's permit and METRC tracking.
Palo Alto
No storefront retailers permitted. Delivery from state-licensed retailers based elsewhere is fully legal — Palo Alto cannot block deliveries that originate outside city limits. This is the case for most residential customers here.
Mountain View
One storefront retailer permitted (Mountain Remedy). Delivery from outside services is also legal. Recreational and medical both fine.
Sunnyvale
No storefront retailers permitted within city limits. Like Palo Alto, delivery from licensed retailers is fully legal and is how most Sunnyvale residents purchase.
Los Altos & Los Gatos
No storefronts. Delivery is legal.
San Jose
Multiple storefronts permitted, plus delivery. The most permissive city in the county.
